DMCA Notice & Takedown

Layerseven TV respects the intellectual property rights of others and expects the same of our users and the third-party providers whose content is delivered through the Service. We comply with the United States Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, and have adopted the policy below for handling claims of copyright infringement. Layerseven TV does not host, store, or originate any of the audiovisual content available through the Catchon TV application; channel feeds and on-demand catalogs are supplied by third-party providers. Where a notice concerns content controlled solely by an upstream provider, we will work with that provider to investigate and route the complaint appropriately.

1. Designated Agent

Layerseven TV has designated an agent to receive notifications of claimed copyright infringement under 17 U.S.C. § 512(c)(2). All DMCA notices and counter-notices must be submitted in writing to:

Submitting unrelated requests (refunds, technical support, sales questions) to the DMCA address will delay handling of legitimate copyright complaints. Please use our contact page for non-copyright matters.

2. Required Elements of a DMCA Notice

To be effective under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must be a written communication that includes substantially all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material — including, where applicable, the channel name, program title, broadcast time, and direct URL or stream identifier.
  4. Information reasonably sufficient to permit us to contact the complaining party — name, mailing address, telephone number, and a valid email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Notices that omit any of the above elements may be deemed defective and may not be acted upon. Please be advised that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3. Our Response to a Valid Notice

Upon receipt of a notice that substantially complies with Section 2, Layerseven TV will, in accordance with the DMCA: (a) expeditiously remove or disable access to the material identified in the notice to the extent it is within our control, (b) forward the notice to the responsible upstream provider where the content is supplied by a third party, and (c) take reasonable steps to notify the affected subscriber that the material has been removed or disabled. We will not provide subscriber identity information except as required by law or in response to a valid subpoena.

4. Counter-Notice Procedure

If you believe that material attributed to you was removed or disabled by mistake or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). A valid counter-notice must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Layerseven TV may be found, and that you will accept service of process from the person who submitted the original notice or an agent of such person.

Submit counter-notices to help@catchontv1.email with the subject line "DMCA Counter-Notice." Upon receipt of a valid counter-notice, we will promptly provide a copy to the original complaining party and inform them that we may replace the removed material or cease disabling access to it in not less than ten (10) and not more than fourteen (14) business days, unless the complaining party first files an action seeking a court order against the subscriber.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Layerseven TV has adopted and reasonably implements a policy that provides for the termination, in appropriate circumstances, of subscribers who are repeat infringers. Accounts that receive multiple substantiated DMCA notices, or that are the subject of repeated good-faith infringement claims, may be suspended or terminated without refund. We also reserve the right, in our sole discretion, to terminate the account of any subscriber who we believe is engaged in copyright infringement, even on a single occurrence where the conduct is egregious.

6. Modifications

We may update this DMCA policy from time to time. Material changes will be posted on this page with a revised "Last updated" date. The most current version applies to all notices and counter-notices received on or after that date.
